These Terms of Sale apply to purchases made through PixelPeakImages.
By placing an order, you agree to these Terms of Sale.
1. Seller
PixelPeakImages is operated by an independent photographer based in the United Kingdom.
Products displayed through PixelPeakImages are sold by me. Pixieset provides the online platform used to display products, process orders and, where applicable, facilitate payment, printing and fulfilment.
2. Products
PixelPeakImages offers photographic prints and digital image files.
Product descriptions, available sizes, formats and prices are displayed at the time of purchase.
Photographic prints may be produced by professional print laboratories used through the Pixieset fulfilment service.
3. Colour and appearance
I make reasonable efforts to ensure that product images and descriptions accurately represent the products offered.
However, colours and appearance may vary between monitors, screens and physical prints. Minor differences between an on-screen image and the final physical print do not necessarily indicate a defect.
4. Orders and payment
An order is accepted after successful payment unless I notify you that the order cannot be fulfilled.
Payment is processed through the payment method available at checkout.
Prices, applicable taxes and delivery charges are shown during checkout where applicable.
5. Digital products
Digital products are supplied as downloadable photographic image files.
The specific file format, resolution and permitted use are determined by the product description and the Digital Image License applicable to the purchase.
Purchasing a digital image does not transfer copyright or ownership of the photograph.
6. Physical prints
Physical prints are produced according to the options selected at checkout.
Where Pixieset's automatic fulfilment service is used, the order is produced and shipped through Pixieset's fulfilment partners.
I am responsible for the photographic content and the product configuration offered through PixelPeakImages. Production and delivery are performed by the relevant fulfilment providers.
7. Delivery
Digital products are normally made available electronically after successful payment.
Physical products are shipped using the delivery method available for the selected product and destination.
Estimated delivery times are provided during checkout where available. Delivery times may vary because of production, customs, postal services or circumstances outside my reasonable control.
8. Defective or damaged products
If a physical product arrives damaged or defective, please contact me as soon as reasonably possible and provide photographs showing the problem and the packaging where relevant.
Where a product is defective or does not conform to the contract, I will provide an appropriate remedy in accordance with applicable UK consumer law.
9. Cancellation and returns
Nothing in these Terms of Sale limits or excludes any statutory consumer rights that cannot legally be excluded.
For eligible distance purchases of physical goods, you may have a statutory right to cancel within the applicable cancellation period.
Certain products may be exempt from cancellation rights where permitted by law, including goods made to the customer's specifications or clearly personalised goods.
If you wish to cancel an eligible order, please contact me using the contact details provided on PixelPeakImages.
10. Digital downloads and cancellation
For digital content, statutory cancellation rights may be affected once supply of the digital content begins.
Where required by law, you will be asked to expressly acknowledge that supply of the digital content may begin before the end of the applicable cancellation period and that you may lose the statutory right to cancel once supply begins.
This does not affect your statutory rights in relation to defective or non-conforming digital content.
11. Copyright
All photographs remain protected by copyright.
Unless expressly stated otherwise, purchasing a print or digital file does not transfer copyright or grant any licence beyond the rights expressly stated in the applicable Digital Image License.
12. Limitation of liability
Nothing in these Terms of Sale excludes or limits liability that cannot legally be excluded or limited under applicable law.
Subject to this, I am not responsible for indirect or consequential losses that are not reasonably foreseeable.
13. Changes
I may update these Terms of Sale from time to time. The version applicable to an order is the version in force when the order is placed.

Digital Image License

This Digital Image License applies to digital photographic images purchased from PixelPeakImages.
Purchasing or downloading a digital image does not transfer copyright ownership.
1. Copyright
All photographs and digital image files remain the intellectual property of the photographer and are protected by applicable copyright laws.
The copyright is not sold or transferred to the purchaser.
2. Personal licence
Unless a different licence is expressly stated on the product page, the purchaser receives a non-exclusive, non-transferable licence to use the purchased digital image for personal, non-commercial purposes.
Permitted personal uses include:
displaying the image in a private home;
using it as personal wallpaper or screensaver;
making personal copies for archival purposes;
sharing the image with members of your household for personal use.
3. Prohibited uses
Without prior written permission, you may not:
resell the digital image;
sublicense, distribute or give the original file to third parties;
use the image commercially;
use the image in advertising or promotional materials;
use the image in products for resale;
upload the original file to stock-photo libraries or image-sharing services;
claim the photograph as your own work;
remove copyright or ownership information where present;
use the image in a way that infringes the photographer's copyright or other rights.
4. Commercial use
Commercial, editorial, advertising, promotional, publishing or other professional use requires a separate written licence.
If you require commercial rights, please contact PixelPeakImages before using the image for such purposes.
5. Modification
Reasonable personal adjustments such as cropping, resizing or colour adjustment for personal display are permitted.
You may not modify or manipulate the image for resale, commercial use, misleading purposes or in a manner that falsely suggests that you created the photograph.
6. Printing
The purchaser may make personal prints of the purchased digital image for private, non-commercial use.
The digital file may not be supplied to a commercial printer for any purpose other than producing the purchaser's permitted personal print.
7. Transfer
The licence is granted to the original purchaser only and may not be transferred, sold, sublicensed or assigned to another person.
8. No ownership transfer
Payment for a digital image grants the rights described in this licence only.
It does not transfer copyright, intellectual-property rights or ownership of the original photograph.
9. Breach of licence
Any use outside the scope of this licence is unauthorised and may constitute copyright infringement.
The photographer reserves all rights not expressly granted by this licence.
10. Acceptance
By purchasing or downloading a digital image from PixelPeakImages, you acknowledge that you have read and accepted this Digital Image License.
Shipping & Returns

Shipping
Physical photographic products purchased through PixelPeakImages are produced and shipped through the fulfilment service selected for the product.
The available delivery methods, destinations, shipping costs and estimated delivery times are shown during checkout.
Delivery times are estimates and may be affected by production times, weekends, public holidays, customs procedures, postal services or circumstances outside my reasonable control.
Once an order has been dispatched, tracking information will be provided where the selected delivery service supports tracking.
Customs and import charges
For international deliveries, the recipient may be responsible for customs duties, import taxes or other charges imposed by the destination country.
Such charges are outside my control and are not included unless expressly stated during checkout.
Damaged or defective products
If your print or other physical product arrives damaged or defective, please contact me as soon as possible.
Please provide:
your order number;
photographs of the damaged or defective product;
photographs of the packaging, where relevant.
I will work with the applicable fulfilment provider to arrange an appropriate remedy.
Where required by UK consumer law, your statutory rights remain unaffected.
Returns and cancellations
Nothing in this policy limits your statutory consumer rights.
Where a statutory cancellation right applies to an online purchase, you may cancel the order within the applicable legal period and receive the refund required by law.
Certain products may be excluded from cancellation rights where permitted by law, including products made to your specifications or clearly personalised products.
If you wish to cancel an eligible order, please contact me before returning anything so that I can provide the appropriate instructions.
Digital products
Digital downloads are supplied electronically and are not physically shipped.
Once digital content has been supplied, cancellation rights may be affected in accordance with applicable law, particularly where you have expressly agreed to immediate supply and acknowledged the resulting effect on your cancellation rights.
This does not affect your statutory rights if the digital content is faulty or does not conform to the contract.
Refunds
Where you are legally entitled to a refund, it will be processed using the applicable payment method and within the period required by law.
If a product is defective or damaged, I may offer a replacement or refund as appropriate to the circumstances and applicable consumer law.
